Lawyers

To be referred to as a lawyer you will need to have been successfully trained in aspects of law; also known by the title attorney, advisor or advocate. As advocates, lawyers can represent one of the parties in criminal and civil trials by presenting evidence and arguing in court to support their client; not all want or will appear in court whilst others dedicate their whole lives to courtroom appearances. When acting as a legal advisor, their responsibility is to provide legal guidance; whether the matter is personal or business, they are there to provide assistance. Trial lawyers have greater familiarity with courtroom rules and strategy; of particular importance in trial work is the ability to think quickly and speak with ease and authority.Trial lawyers actually spend more of their time outside the court; conducting research, interviewing clients and witnesses plus handling other details in preparation for trial. Our entire society is affected by laws and the legal profession; whether buying a home to crossing the street, lawyers hold positions of great responsibility and are obliged to follow a strict code of ethics. Owing to the nature of specialization with legal representatives, they may never actually attend court; although they are licensed to represent their clients there. For almost every area of society there is a specialist branch of the legal system; examples of just a few are show below:*Bankruptcy *Aviation Law *International law *Personal Injury *Identification Theft The need to practice every area of law in a courtroom is minimal! Representing environmental issues can mean they may work for the government or private companies; a few examples are listed here: *Waste Disposal Companies *State agencies *Land Developers Part of this work is dealing with land and development applications; it can also be in a defense capacity when incidents have happened that require legal representation. Attorneys are also involved with laws protecting intellectual property rights, an area much in the news of late; property like digital media, CD’s, computer games and software for instance, are particularly at risk since the advent of the Internet. Some lawyers who specialize in insurance law are employed in permanent positions within insurance companies; insurance terms and conditions often change to protect the company from fraudulent claims but they can also be useful performing insurance investigations. Despite these different areas of legislature, most attorneys will practice in the field of either criminal or civil law; criminal lawyers defend or prosecute persons charged with a crime; civil law uses their talents to argue in a civil court over claims, mortgages and other types of litigation. Close to the top of the ladder are those legal specialists that manage what are known as high profile ‘public interest’ cases; these cases may have an impact affecting communities in general, not just an individual, and can involve anything from government regulations to property interests. Lawyers with a more rounded social conscience can work for non-profit organizations or legal-aid centers; the work involved might mean providing legal assistance or representation to people who are not in a position to help themselves.

John Adams

I have been watching the Miniseries “John Adams” on HBO… it is incredible… so gripping, so moving… it has really grabbed me and pulled me into that time period.

I thought it was interesting that John Adams was an Attorney. In the show, the first episode is about how he defends British soldiers accused of murder, and the courage it took for him to defend the most hated people in the are at the time… and that all he cared about was preserving the law…

Anyone else watching this ?

Office pools illegal ?

Are office pools illegal ?

Well, I just finished watching a newscast that says that in the State of California, office betting pools of any kind are in fact illegal.

In fact, they had a story on a old lady who was running one from an elks lodge who got busted…

I can’t believe that the police actually had time to run that one down.

Right to bear arms finally has its day in court…

The US SUPREME COURT will hear arguments that could potentially strengthen gun rights.

A Washington man is asking the Justices to allow him to carry a gun in his home. The decisions rendered will mean either a huge blow for gun rights or a massive strengthening of the right to bear arms.

I don’t know which way its going to end up… but, either way, it will be a huge decision, that which the effects will be felt for years to come.
